These Terms and Conditions apply to services, programmes, assessments/profiles, courses and workshops purchased from or provided by In Balance, operated by Suzaan Wessels as a sole proprietor in South Africa.
By booking a service, purchasing a product or programme, registering for a course or workshop, or making payment to In Balance, you acknowledge that you have read and accepted these terms.
1. Services Provided
In Balance provides services in the areas of personal development, relationship and communication coaching, Paradigm Profiles, Educational Kinesiology, Brain Gym® and related training, courses and workshops.
Services may be delivered in person or online, depending on the particular service and the arrangement made with the client.
The exact content, duration, format and price of a service or programme will be communicated before purchase or booking.
2. Scope of Services
In Balance provides coaching, personal-development, educational and training services.
Unless expressly stated otherwise, these services are not intended to diagnose or treat a medical, psychiatric or psychological disorder and do not replace appropriate medical, psychological, psychiatric, legal or other regulated professional services.
Paradigm Profiles and other personal-development tools used by In Balance are intended to support self-awareness, understanding, communication and personal development. They are not presented as diagnostic psychological assessments.
Where a client's needs fall outside the scope of the services offered by In Balance, the client may be encouraged to seek assistance from an appropriately qualified healthcare or other professional.
3. Bookings
Appointments are subject to availability and are only regarded as confirmed once the booking has been agreed upon and, where applicable, the required payment has been received.
Clients are responsible for providing accurate contact information when booking, including their correct email address and cellphone number.
Online clients are responsible for having an appropriate internet connection and device for the session.
4. Payments
Payment may be made using the payment methods offered by In Balance at the time of purchase. These may include EFT and approved online payment facilities such as Payfast.
Unless another payment arrangement has been agreed to in writing, payment is due before the booked service, programme, profile, course or workshop commences.
Where a payment plan has specifically been agreed upon, the client remains responsible for payments according to the agreed schedule.
All prices are quoted in South African Rand (ZAR) unless otherwise indicated.
5. Paradigm Profile Orders
Paradigm Profiles involve a third-party profile provider and therefore require an additional fulfilment process.
After payment has been received:
- In Balance processes the client's profile order with the relevant profile provider.
- The client receives or is sent the appropriate assessment/profile link.
- The client completes the assessment.
- The resulting report is generated.
- Where included in the package purchased, a feedback session is arranged with the client.
Paradigm Profiles are therefore not necessarily delivered immediately or automatically following payment.
The client is responsible for providing the correct ID number (to order the correct profile), name and email address required for the profile order.
Once In Balance has purchased, ordered, or activated an individual profile on the client's behalf, a cost has been incurred with the third-party provider. Consequently, the profile component of the purchase may no longer be refundable once that order or activation has taken place, subject to applicable South African consumer law.
6. Coaching and Individual Session Cancellations
In Balance understands that circumstances sometimes change.
Clients are requested to provide at least 24 hours' notice if they need to cancel or reschedule an individual or couple session.
Where at least 24 hours' notice is provided, the session may ordinarily be rescheduled without an additional charge.
Where a client cancels with less than 24 hours' notice or does not attend a confirmed appointment, the session may be regarded as used and may be charged in full, except where applicable law provides otherwise or exceptional circumstances are accepted by In Balance.
In Balance reserves the right to exercise reasonable discretion in genuine emergencies.
If In Balance needs to cancel or reschedule an appointment, the client will be offered another suitable appointment time.
7. Courses and Workshops
Registration for a course or workshop is confirmed once the required payment, or an agreed deposit/payment, has been received.
If a participant can no longer attend, they should notify In Balance as soon as possible.
Where cancellation is received sufficiently in advance and In Balance has not yet incurred non-refundable costs associated with the participant's registration, a refund or transfer to another available date may be considered.
Where course materials, licences, registrations, third-party fees, profile costs or other non-refundable expenses have already been incurred on behalf of the participant, those amounts may be deducted from any refund, subject to applicable law.
If In Balance cancels a course or workshop and no suitable alternative date is accepted by the participant, payments made for the cancelled event will be refunded.
8. Refunds
Refund requests must be submitted to In Balance in writing.
Each valid request will be considered according to:
- the service or product purchased;
- whether the service has already commenced or been provided;
- whether a profile or other third-party product has already been purchased or activated;
- whether course materials or digital resources have already been supplied;
- costs already incurred by In Balance; and
- the client's rights under applicable South African consumer legislation.
A refund will not ordinarily be provided for a service that has already been fully rendered.
Nothing in this policy is intended to remove or limit any rights a consumer has under applicable South African law, including the Consumer Protection Act 68 of 2008, where applicable.
Where a refund is approved, it will ordinarily be made using an appropriate payment method and processed within a reasonable period.
9. Service Delivery
In Balance does not primarily sell physical goods. References to “delivery” therefore generally refer to the delivery or fulfilment of services, profiles, reports, courses, workshops and digital materials.
Depending on the product or service purchased, delivery may take place through:
- an in-person appointment;
- an online session;
- an emailed assessment/profile link;
- an electronic report or resource;
- access to a course or workshop;
- electronic course materials; or
- another delivery method agreed with the client.
Where a specific date and time has been booked, the service will be delivered at the agreed date and time, subject to unforeseen circumstances.
Where third-party systems are involved, such as profile platforms or online meeting services, reasonable delays outside the direct control of In Balance may occasionally occur. In Balance will take reasonable steps to assist the client where such a delay affects delivery.
10. Digital Materials and Intellectual Property
Course materials, workbooks, worksheets, presentations, reports and other resources supplied by In Balance remain subject to applicable intellectual-property rights.
Unless expressly permitted, materials supplied for a client's personal use may not be copied, reproduced, resold, distributed, uploaded publicly or used commercially without written permission from the relevant rights holder.
Third-party materials, trademarks and assessment/profile systems remain the property of their respective owners.
11. Confidentiality and Personal Information
In Balance respects the privacy and confidentiality of clients.
Personal information is collected and processed only where reasonably necessary to provide services, administer bookings and payments, communicate with clients, fulfil profile or course orders, and meet applicable legal and administrative requirements.
Where a service requires information to be submitted to a third-party provider—for example, to generate a Paradigm Profile—only information reasonably necessary to provide that service will be shared.
Personal information will be handled in accordance with applicable South African data-protection requirements, including the Protection of Personal Information Act 4 of 2013 (POPIA).
Payment-card information submitted through an external payment provider such as Payfast is processed through that provider's systems and is not ordinarily collected or stored directly by In Balance.
12. Results and Client Responsibility
Coaching, personal-development work, profiles, courses and workshops are collaborative processes.
While In Balance aims to provide high-quality services and practical tools, individual outcomes differ. No specific personal, relationship, educational, professional, financial or other outcome can be guaranteed.
Clients remain responsible for their own decisions, actions and implementation of information discussed or provided through In Balance services.
13. Changes to Bookings, Services or Programmes
In Balance may occasionally need to make reasonable changes to appointment times, course dates, facilitators, delivery methods or programme arrangements due to circumstances outside its reasonable control.
Where a material change affects a paid service, In Balance will communicate with affected clients and, where appropriate, offer a reasonable alternative.
14. Website Information
In Balance takes reasonable care to ensure that information on its website is accurate and current.
However, course dates, availability, prices and programme details may change from time to time. Where there is a material discrepancy, the information specifically confirmed to the client at the time of booking or purchase will apply, subject to applicable law.
15. Governing Law
These Terms and Conditions are governed by the laws of the Republic of South Africa.
Nothing in these terms is intended to exclude, restrict or override any consumer right that may not lawfully be excluded under South African legislation.
